Declaró la nulidad de Sentencia T-120/93, lo anterior, debido al desconocimiento de la cosa juzgada constitucional que implicó la violación del debido proceso, al dictarse la mencionada sentencia, precisamente por desconocerse el mandato del inciso primero del Art.243 de la Constitución.
En este sentido, mediante este auto ordenó comunicar al Superintendente de Sociedades y al Juez que conoció en primera instancia de la acción de tutela instaurada para que enviara el expediente a la Corporación y dictar la sentencia correspondiente.

- R E S U E L V E :
- 1o. DECLARASE nula la sentencia T-120 dictada por la Sala Septima de Revision, el dia 29 de marzo de 1993, en el proceso T-5088.
- 2o. COMUNIQUESE este auto al Superintendente de Sociedades y al Juez 24 Civil del Circuito de Santafe de Bogota, quien conocio en primera instancia de la accion de tutela instaurada por Pinski Asociados & S.A.
- 3o. Se ORDENA al mismo Juzgado 24 Civil del Circuito, el envio del expediente de tutela de Pinski Asociados & S.A., a la Corte Constitucional para dictar la sentencia correspondiente.
